1. These pages. These Terms govern your use of the TrustCraft Legal Services pages at trustcraft.ai (these “Pages”), which are published by TrustCraft Legal Services PLLC, a New York professional limited liability company (the “Firm”). Other pages at trustcraft.ai are published by TrustCraft LLC, a separate consulting company that is not a law firm, and are governed by their own terms. By using these Pages you agree to these Terms.
2. Information, not advice. The content here is general information about the Firm and about legal developments. It is not legal advice, and you should not act or refrain from acting on it without advice from counsel in the relevant jurisdiction about your own circumstances. Content speaks as of its publication date and is not updated for later developments.
3. No attorney-client relationship. Using these Pages, reading their content, submitting a form, or sending email does not create an attorney-client relationship. The Firm represents a client only under a written engagement agreement signed by the Firm after a conflicts check.
4. Confidentiality limitations. Do not send confidential or sensitive information until the Firm has confirmed in writing that it represents you. Information sent before then is not protected by the attorney-client privilege. The Firm will handle it in accordance with its professional obligations, but sending it does not create any relationship with the Firm and does not prevent the Firm from representing a person whose interests are adverse to yours.
5. Admission and scope of practice. The Firm’s practice is limited to the law of the State of New York and United States federal law. Nothing on these Pages is an offer to practice law in any jurisdiction where the Firm is not authorized to do so.
6. Intellectual property. Content on these Pages is owned by the Firm or its licensors. You may view, download, print, and share a link to it for your own personal or internal business use. Other copying, modification, republication, or creation of derivative works requires the Firm's written permission.
7. Third-party links. These Pages may link elsewhere. The Firm does not control those sites, is not responsible for them, and a link is neither an endorsement nor a referral.
8. Disclaimer. THESE PAGES AND THEIR CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND WARRANTIES AS TO ACCURACY, COMPLETENESS, OR AVAILABILITY. The Firm does not warrant that these Pages or any email from it are free of harmful components.
9. Limitation. TO THE FULLEST EXTENT PERMITTED BY LAW, THE FIRM IS NOT LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THESE PAGES, WHETHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE, AND WHETHER IN CONTRACT, TORT, OR OTHERWISE. WHERE AN EXCLUSION ABOVE IS NOT PERMITTED, THE FIRM'S TOTAL LIABILITY ARISING FROM THESE PAGES WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).
This Section and Section 8 apply to your use of these Pages only. They do not apply to, and do not limit, any obligation the Firm owes under an engagement agreement, and nothing here limits any liability that may not be limited under applicable law or under the rules of professional conduct governing lawyers.
10. If you are a client. Your engagement agreement governs the Firm's work for you and controls over these Terms as to anything within its scope.
11. Governing law. These Terms are governed by the laws of the State of New York. Any dispute relating to these Terms or these Pages will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to that jurisdiction and venue.
12. General. The Firm may update these Terms; the "Last updated" date will change and material changes will be noted on this page for a reasonable period. If any provision is unenforceable, the rest stands. The Firm's failure to enforce a provision is not a waiver. These Terms, with the Firm's Privacy Policy, are the entire agreement about your use of these Pages.
